IADL Condemns Israeli Attacks on Al-Aqsa Mosque and Jerusalem and Expresses Solidarity with the Palestinian People

The International Association of Democratic Lawyers (IADL) condemns the escalating Israeli attacks on occupied Jerusalem and the Palestinian people, including repeated incursions into the Al-Aqsa Mosque compound under the protection of Israeli occupation forces; arrests and exclusion orders targeting Palestinian worshippers; restrictions on access to the Old City and its holy sites; attacks on the Ibrahimi Mosque in occupied al-Khalil (Hebron); and escalating settler violence against Palestinian communities throughout the West Bank of occupied Palestine.

These attacks form part of the broader regime of unlawful occupation, settlement, annexation, dispossession and forced displacement imposed upon the Palestinian people, alongside the ongoing genocidal destruction of Palestinian life in Gaza and the denial of the right of return to Palestinian refugees.

In recent weeks, Israeli authorities have dramatically intensified restrictions on Palestinian access to Al-Aqsa while facilitating large-scale incursions by Israeli settlers and senior political officials. On 28 September 2026 (the 26th anniversary of the Al-Aqsa Intifada, the Palestinian uprising launched in 2000 after then-Israeli Prime Minister Ariel Sharon’s incursion into the Mosque), Israeli National Security Minister Itamar Ben-Gvir entered the Al-Aqsa compound together with hundreds of Israeli settlers under police protection.

During this period, Israeli forces closed streets and intersections around Jerusalem’s Old City, while Palestinian businesses were forced to close and Palestinian residents faced severe restrictions on movement. Settlers performed collective religious rituals within the compound during these incursions and stated their intention to demolish Al-Aqsa Mosque and replace it with a Jewish temple.

The Jerusalem Governorate reports that 40,661 Israeli settlers entered Al-Aqsa between the beginning of 2026 and the end of August. Approximately 800 orders barring Palestinian worshippers from Al-Aqsa had been issued by early September. During the third quarter of 2026 alone, the Governorate documented 357 arrests of Palestinians in Jerusalem and 73 expulsion or exclusion orders, including 63 relating to Al-Aqsa.

The IADL emphasizes that occupied Jerusalem is part of the Occupied Palestinian Territory. Israel’s purported annexation of East Jerusalem has never altered its status under international law. In its Advisory Opinion of 19 July 2024, the International Court of Justice (ICJ) reaffirmed that East Jerusalem and the West Bank are occupied territory and concluded that Israel’s continued presence in the Occupied Palestinian Territory is unlawful. The Court further found that Israel’s settlement and annexation policies violate the Palestinian people’s right to self-determination.

UN Security Council Resolution 2334 (2016) similarly reaffirmed that Israeli settlements in the territory occupied since 1967, including East Jerusalem, have “no legal validity.” Israeli restrictions on Palestinian Muslims and Christians’ access to holy places also violate Article 18 of the International Covenant on Civil and Political Rights and the protections afforded to the occupied population by the Fourth Geneva Convention.

In occupied al-Khalil, Israeli forces closed the Ibrahimi Mosque to Palestinian Muslim worshippers from 28 through 30 September, closed checkpoints and electronic gates, and facilitated the entry of hundreds of Israeli settlers. This followed months of restrictions, including a ban on the call to prayer lasting over three consecutive months and repeated closures of the mosque to Palestinians in favour of settler access.

Article 49(6) of the Fourth Geneva Convention prohibits an occupying Power from transferring parts of its civilian population into occupied territory. The ICJ reaffirmed in 2024 that Israel’s transfer of settlers into the West Bank and East Jerusalem, and its maintenance of their presence there, violate international law.

The IADL is further alarmed by the extraordinary escalation of settler violence. According to UN OCHA, by 14 September more than 1,600 settler attacks resulting in Palestinian casualties, property damage or both had been recorded in 2026, affecting 275 Palestinian communities. These attacks include shootings and physical assaults, attacks on homes, destruction of agricultural land and olive trees, attacks on livestock and water infrastructure, and actions contributing directly to the displacement of Palestinian communities.

The occupying Power cannot dismiss this violence as merely private conduct while simultaneously creating, expanding, arming and protecting the settlement enterprise. The ICJ specifically concluded in 2024 that Israel’s systematic failure to prevent or punish settler attacks against Palestinians violates its obligations under the Hague Regulations, Fourth Geneva Convention and International Covenant on Civil and Political Rights.

Article 49(1) of the Fourth Geneva Convention also prohibits forcible transfer of the occupied population. Settler attacks, land seizures, home demolitions, destruction of livelihoods and discriminatory movement restrictions must therefore be considered together in assessing the coercive displacement of Palestinians from their land.

The attack on Jerusalem and the West Bank cannot be separated from the ongoing genocide committed by Israel in Gaza. The destruction of Palestinian homes, hospitals, schools, universities, cultural and religious institutions in Gaza; the imprisonment of thousands of Palestinian political prisoners subjected to torture, starvation, and cruel, inhuman and degrading treatment; settlement expansion and settler and military violence throughout the West Bank; and attempts to alter the Palestinian, Arab, Muslim and Christian character of Jerusalem form part of the broader denial of the Palestinian people’s right to exist, remain on their land and exercise self-determination.

The Genocide Convention imposes upon States an affirmative obligation to prevent genocide. These obligations demand concrete action, rather than verbal expressions of concern while weapons, financing, diplomatic protection and commercial relations continue to sustain violations of international law.

As the IADL and Progressive International delegation to Palestine concluded in 2025: “Now is the time for a total energy, economic and arms embargo against Israel. Nothing less can detain the genocide of the Palestinian people and dismantle the architecture of apartheid in their Occupied Territories.”

The IADL calls upon all States to comply with their obligations under the Fourth Geneva Convention, Genocide Convention and customary international law; implement the findings of the International Court of Justice; refrain from recognizing or assisting Israel’s unlawful presence and settlement regime in occupied Palestinian territory; and ensure that arms, financing, trade and other assistance do not contribute to violations of international law.

We further call for full accountability for Israeli and third-State officials, soldiers and other complicit institutions, including officials of the United States, through national and international mechanisms for war crimes, crimes against humanity and other international crimes, up to and including genocide.

الرابطة الدولية للمحامين الديمقراطيين تدين الاعتداءات الإسرائيلية على المسجد الأقصى والقدس وتعرب عن تضامنها مع الشعب الفلسطيني

تدين الرابطة الدولية للمحامين الديمقراطيين (IADL) تصاعد الاعتداءات الإسرائيلية على القدس المحتلة والشعب الفلسطيني، بما في ذلك الاقتحامات المتكررة لباحات المسجد الأقصى تحت حماية قوات الاحتلال الإسرائيلي؛ وعمليات الاعتقال وأوامر الإبعاد التي تستهدف المصلين الفلسطينيين؛ والقيود المفروضة على الوصول إلى البلدة القديمة وأماكنها المقدسة؛ والاعتداءات على المسجد الإبراهيمي في الخليل المحتلة؛ وتصاعد عنف المستوطنين ضد التجمعات الفلسطينية في مختلف أنحاء الضفة الغربية من فلسطين المحتلة.

وتأتي هذه الاعتداءات في إطار منظومة أوسع من الاحتلال غير القانوني والاستيطان والضم وسلب الأراضي والممتلكات والتهجير القسري المفروضة على الشعب الفلسطيني، إلى جانب التدمير الإبادي المستمر للحياة الفلسطينية في غزة، وحرمان اللاجئين الفلسطينيين من حق العودة.

وخلال الأسابيع الأخيرة، صعّدت السلطات الإسرائيلية بشكل كبير القيود المفروضة على وصول الفلسطينيين إلى المسجد الأقصى، في الوقت الذي سهّلت فيه اقتحامات واسعة النطاق للمستوطنين الإسرائيليين وكبار المسؤولين السياسيين. وفي 28 أيلول/سبتمبر 2026 (الذكرى السادسة والعشرين لانتفاضة الأقصى، الانتفاضة الفلسطينية التي اندلعت عام 2000 عقب اقتحام رئيس الوزراء الإسرائيلي آنذاك أرييل شارون للمسجد)، اقتحم وزير الأمن القومي الإسرائيلي إيتمار بن غفير باحات المسجد الأقصى برفقة مئات المستوطنين الإسرائيليين وتحت حماية الشرطة.

وخلال هذه الفترة، أغلقت القوات الإسرائيلية الشوارع والتقاطعات المحيطة بالبلدة القديمة في القدس، فيما أُجبر أصحاب المحال التجارية الفلسطينيون على إغلاق محالهم، وفُرضت قيود مشددة على حركة السكان الفلسطينيين. وأدى المستوطنون طقوساً دينية جماعية داخل باحات المسجد خلال هذه الاقتحامات، وأعلنوا نيتهم هدم المسجد الأقصى وإقامة هيكل يهودي مكانه.

وتفيد محافظة القدس بأن 40,661 مستوطناً إسرائيلياً اقتحموا المسجد الأقصى بين بداية عام 2026 ونهاية شهر آب/أغسطس. وبحلول مطلع أيلول/سبتمبر، كان قد صدر نحو 800 أمر بإبعاد المصلين الفلسطينيين عن المسجد الأقصى. وخلال الربع الثالث من عام 2026 وحده، وثقت المحافظة 357 حالة اعتقال لفلسطينيين في القدس و73 أمر طرد أو إبعاد، من بينها 63 أمراً متعلقاً بالمسجد الأقصى.

وتؤكد الرابطة الدولية للمحامين الديمقراطيين أن القدس المحتلة جزء من الأرض الفلسطينية المحتلة. ولم يغيّر ضم إسرائيل المزعوم للقدس الشرقية من وضعها بموجب القانون الدولي. وفي فتواها الصادرة في 19 تموز/يوليو 2024، أكدت محكمة العدل الدولية مجدداً أن القدس الشرقية والضفة الغربية أراضٍ محتلة، وخلصت إلى أن استمرار وجود إسرائيل في الأرض الفلسطينية المحتلة غير قانوني. كما خلصت المحكمة إلى أن سياسات إسرائيل الاستيطانية والضم تنتهك حق الشعب الفلسطيني في تقرير المصير.

وبالمثل، أكد قرار مجلس الأمن التابع للأمم المتحدة رقم 2334 (2016) مجدداً أن المستوطنات الإسرائيلية في الأراضي المحتلة منذ عام 1967، بما فيها القدس الشرقية، «ليس لها أي شرعية قانونية». كما أن القيود الإسرائيلية المفروضة على وصول المسلمين والمسيحيين الفلسطينيين إلى الأماكن المقدسة تنتهك المادة 18 من العهد الدولي الخاص بالحقوق المدنية والسياسية، والحماية المقررة للسكان الواقعين تحت الاحتلال بموجب اتفاقية جنيف الرابعة.

وفي الخليل المحتلة، أغلقت القوات الإسرائيلية المسجد الإبراهيمي أمام المصلين المسلمين الفلسطينيين من 28 وحتى 30 أيلول/سبتمبر، وأغلقت الحواجز والبوابات الإلكترونية، وسهّلت دخول مئات المستوطنين الإسرائيليين. وجاء ذلك بعد أشهر من القيود، بما في ذلك حظر رفع الأذان لأكثر من ثلاثة أشهر متتالية، والإغلاق المتكرر للمسجد أمام الفلسطينيين لصالح إتاحة الدخول للمستوطنين.

وتحظر المادة 49(6) من اتفاقية جنيف الرابعة على دولة الاحتلال نقل أجزاء من سكانها المدنيين إلى الأراضي التي تحتلها. وقد أكدت محكمة العدل الدولية مجدداً في عام 2024 أن نقل إسرائيل للمستوطنين إلى الضفة الغربية والقدس الشرقية، وإبقاء وجودهم فيها، يشكلان انتهاكاً للقانون الدولي.

وتعرب الرابطة الدولية للمحامين الديمقراطيين كذلك عن بالغ قلقها إزاء التصاعد الاستثنائي لعنف المستوطنين. فوفقاً لمكتب الأمم المتحدة لتنسيق الشؤون الإنسانية (OCHA)، سُجّل حتى 14 أيلول/سبتمبر أكثر من 1,600 اعتداء للمستوطنين خلال عام 2026 أسفرت عن إصابات في صفوف الفلسطينيين أو أضرار بالممتلكات أو كليهما، وطالت 275 تجمعاً فلسطينياً. وتشمل هذه الاعتداءات إطلاق النار والاعتداءات الجسدية، والهجمات على المنازل، وتدمير الأراضي الزراعية وأشجار الزيتون، والاعتداء على المواشي والبنية التحتية للمياه، وممارسات تسهم بصورة مباشرة في تهجير التجمعات الفلسطينية.

ولا يجوز لدولة الاحتلال أن تتنصل من مسؤوليتها عن هذا العنف باعتباره مجرد أفعال خاصة يرتكبها أفراد، في الوقت الذي تعمل فيه على إنشاء المشروع الاستيطاني وتوسيعه وتسليحه وحمايته. وقد خلصت محكمة العدل الدولية تحديداً في عام 2024 إلى أن إخفاق إسرائيل المنهجي في منع اعتداءات المستوطنين على الفلسطينيين أو معاقبة مرتكبيها ينتهك التزاماتها بموجب لوائح لاهاي واتفاقية جنيف الرابعة والعهد الدولي الخاص بالحقوق المدنية والسياسية.

كما تحظر المادة 49(1) من اتفاقية جنيف الرابعة النقل القسري للسكان الواقعين تحت الاحتلال. ولذلك، يجب النظر إلى اعتداءات المستوطنين والاستيلاء على الأراضي وهدم المنازل وتدمير سبل العيش والقيود التمييزية على الحركة مجتمعةً عند تقييم التهجير القسري للفلسطينيين من أرضهم.

ولا يمكن فصل الهجوم على القدس والضفة الغربية عن الإبادة الجماعية المستمرة التي ترتكبها إسرائيل في غزة. فتدمير المنازل والمستشفيات والمدارس والجامعات والمؤسسات الثقافية والدينية الفلسطينية في غزة؛ واعتقال آلاف الأسرى السياسيين الفلسطينيين الذين يتعرضون للتعذيب والتجويع والمعاملة القاسية واللاإنسانية والمهينة؛ والتوسع الاستيطاني وعنف المستوطنين والعنف العسكري في مختلف أنحاء الضفة الغربية؛ ومحاولات تغيير الطابع الفلسطيني والعربي والإسلامي والمسيحي للقدس، جميعها تشكل جزءاً من الإنكار الأوسع لحق الشعب الفلسطيني في الوجود والبقاء على أرضه وممارسة حقه في تقرير المصير.

وتفرض اتفاقية منع جريمة الإبادة الجماعية والمعاقبة عليها على الدول التزاماً إيجابياً بمنع الإبادة الجماعية. وتتطلب هذه الالتزامات إجراءات ملموسة، لا مجرد تعبيرات لفظية عن القلق في الوقت الذي تستمر فيه الأسلحة والتمويل والحماية الدبلوماسية والعلاقات التجارية في إدامة انتهاكات القانون الدولي.

وكما خلص وفد الرابطة الدولية للمحامين الديمقراطيين والأممية التقدمية إلى فلسطين في عام 2025: «لقد حان الوقت لفرض حظر شامل على إسرائيل في مجالات الطاقة والاقتصاد والأسلحة. ولا شيء أقل من ذلك يمكن أن يوقف الإبادة الجماعية للشعب الفلسطيني ويفكك بنية الفصل العنصري في أراضيه المحتلة».

وتدعو الرابطة الدولية للمحامين الديمقراطيين جميع الدول إلى الوفاء بالتزاماتها بموجب اتفاقية جنيف الرابعة واتفاقية منع جريمة الإبادة الجماعية والقانون الدولي العرفي؛ وتنفيذ ما خلصت إليه محكمة العدل الدولية؛ والامتناع عن الاعتراف بالوجود الإسرائيلي غير القانوني والنظام الاستيطاني في الأرض الفلسطينية المحتلة أو تقديم المساعدة لهما؛ وضمان ألا تسهم الأسلحة أو التمويل أو التجارة أو غيرها من أشكال المساعدة في انتهاكات القانون الدولي.

وندعو كذلك إلى المساءلة الكاملة للمسؤولين الإسرائيليين ومسؤولي الدول الثالثة، والجنود وغيرهم من المؤسسات المتواطئة، بما في ذلك مسؤولو الولايات المتحدة، من خلال الآليات الوطنية والدولية، عن جرائم الحرب والجرائم ضد الإنسانية وغيرها من الجرائم الدولية، وصولاً إلى جريمة الإبادة الجماعية.
