The right to a fair trial has long been recognised by the international community as a fundamental human right.  Without a fair trial every individual risks becoming the victim of a miscarriage of justice.  Either as an innocent suspect wrongly convicted, or as a victim unable to secure justice for a wrong perpetrated against them.

Ebru Timtik was one of 18 lawyers in Turkey who were members of the Progressive Lawyers Association, some of which were working at the People’s Law Office, made subject to a prosecution in the Istanbul 37th Assize Court under Articles 314 and 220 of the Turkish Penal Code for terrorist offences. She and her colleagues were convicted on 20 March 2019 after a trial during which basic procedural safeguards and internationally recognised fair trial principles were ignored. Her conviction was based on the testimony of anonymous witnesses, many of which gave inconsistent testimony in relation to alleged facts and time periods. Documents allegedly obtained from government authorities in Belgium and the Netherland were never authenticated but they were nevertheless used as grounds for convictions without her lawyers having access to them. The originals of digital documents which were allegedly seized in a musical centre were also not made available to the defence lawyers. They could not see, analyse or challenge these documents which were never shown to have existed. Lawyers acting in her defence were frequently prevented from participating in the proceedings and in some circumstances were excluded.

The defects in the trial process led Ebru Timtik together with one of her colleagues, Aytaç Ünsal, to commence a “death fast” following a hunger strike which began on 5 April 2020, the Turkish “Day of the Lawyer”. Sadly, on 27 August 2020 Ebru Timtik died whilst continuing to protest both her innocence of the charges on which she had been convicted, and the lack of respect for fundamental fair trial principles in the criminal justice system which had prejudiced both her and her colleagues, and many thousands of other individuals in Turkey.

In recognition of her sacrifice, and in order to focus attention on the plight of those in countries around the globe who are facing prosecution in circumstances where fair trial principles are not being observed or respected, a number of international bar associations and lawyers organisations have come together to arrange an annual “International Fair Trial Day” which will be observed every year on 14 June. Steps are also being undertaken to introduce a new annual Ebru Timtik Award to recognise an individual or an organisation who has or which has made an exceptional contribution towards securing fair trial rights in the country on which the International Fair Trial Day is focusing for the year in question. Each year a conference will be held, either online or at a physical location in a country chosen because of the level of concern with regard to the lack of respect for fair trial rights in that jurisdiction at that time. There will also be events in the countries across the word on each International Fair Trial Day to raise awareness of the situation in the focus country.

The steering group consisting of Council of Bars and Law Societies of Europe (CCBE), European Association of Lawyers for Democracy and World Human Rights (ELDH), European Bars Federation (FBE), European Democratic Lawyers (EDL-AED), French National Bar Council (CNB), International Association of Democratic Lawyers (IADL), International Association of Lawyers (UIA), International Bar Association’s Human Rights Institute (IBAHRI), Italian National Bar Council (CNF), Law Society of England and Wales, Lawyers for Lawyers (L4L), Ayşe Bingöl Demir and Serife Ceren Uysal agreed that the first conference will be held as a virtual event on 14 June 2021 and will focus on fair trial rights in Turkey.

We are writing at this stage to advise you of this initiative and to invite your organisation to support International Fair Trial Day and attend the conference. Further details of the programme and of the speakers who will address the conference will follow over the next few months. For now, we would ask you to hold the date to recognise what we hope will be an important annual event and prize-giving on the international rule of law calendar.

La Journée internationale du procès équitable et le Prix Ebru Timtik

Le droit à un procès équitable est depuis longtemps reconnu par la communauté internationale en tant qu’un droit humain fondamental. Sans un procès équitable, tout individu risque d’être victime d’une erreur judiciaire, que ce soit en tant que suspect innocent condamné à tort ou en tant que victime incapable d’obtenir justice pour un acte répréhensible commis à son encontre.

Ebru Timtik était l’un des 18 avocats turcs membres de l’Association des avocats progressistes, dont certains travaillaient au People’s Law Office, qui ont fait l’objet de poursuites devant la 37e Cour d’assises d’Istanbul en vertu des articles 314 et 220 du Code pénal turc pour des infractions terroristes. Elle et ses confrères ont été condamnés le 20 mars 2019 à l’issue d’un procès au cours duquel les garanties procédurales fondamentales et les principes d’un procès équitable reconnus au niveau international ont été bafoués. Sa condamnation a reposé sur le témoignage de personnes anonymes, dont beaucoup ont donné des témoignages incohérents par rapport aux faits et aux périodes présumés. Les pièces prétendument obtenues des autorités gouvernementales en Belgique et aux Pays-Bas n’ont jamais été authentifiés mais ont pourtant servi de motifs de condamnation sans que ses avocats n’y aient accès. Les originaux des pièces numériques qui auraient été saisies dans un centre musical n’ont pas non plus été mis à la disposition des avocats de la défense. Ces derniers n’ont pu ni voir, ni analyser ni contester ces pièces, dont l’existence n’a jamais été prouvée. Ses avocats de la défense ont souvent été empêchés de participer à la procédure et en ont même été exclus dans certaines circonstances.

Les défauts du procès ont conduit Ebru Timtik et un de ses confrères, Aytaç Ünsal, à entamer un « jeûne de la mort » à la suite d’une grève de la faim qui a débuté le 5 avril 2020, qui est la « Journée de l’avocat » en Turquie. Malheureusement, le 27 août 2020, Ebru Timtik est décédée alors qu’elle continuait à clamer son innocence face aux accusations ayant mené à sa condamnation et à protester contre le non-respect des principes fondamentaux d’un procès équitable dans le système de justice pénale, ce qui a porté préjudice aussi bien à elle qu’à ses confrères et à des milliers d’autres personnes en Turquie.

En reconnaissance de son sacrifice, et afin d’attirer l’attention sur la situation critique des personnes qui, dans les pays du monde entier, sont poursuivies dans des circonstances où les principes relatifs à un procès équitable ne sont pas observés ou respectés, un certain nombre d’associations internationales de barreaux et d’organisations d’avocats se sont réunies pour organiser une « Journée internationale du procès équitable » qui sera célébrée chaque année le 14 juin. Des mesures sont également prises pour créer un prix annuel, le prix Ebru Timtik, afin de récompenser une personne ou une organisation ayant contribué de manière exceptionnelle à garantir le droit à un procès équitable dans le pays sur lequel porte la Journée internationale du procès équitable l’année en question. Chaque année, une conférence sera organisée, en ligne ou dans le pays choisi en raison du niveau de préoccupation concernant le manque de respect des droits à un procès équitable dans cette juridiction à ce moment-là. Des événements seront également organisés dans le monde entier à l’occasion de chaque Journée internationale du procès équitable afin d’accroitre la sensibilisation à la situation dans le pays concerné.

Le groupe pilote, composé du Conseil des barreaux européens (CCBE), de l’Association européenne des juristes pour la démocratie et les droits de l’homme (ELDH), de la Fédération des Barreaux d’Europe (FBE), de European Democratic Lawyers (EDL-AED), du Conseil national des Barreaux de France (CNB), de l’Association internationale des juristes démocrates (AIJD), de l’Union internationale des avocats (UIA), de l’Institut des droits de l’homme de l’Association internationale du barreau (IBAHRI), du Consiglio Nazionale Forense (CNF), de la Law Society of England and Wales, de Lawyers for Lawyers (L4L), d’Ayşe Bingöl Demir et de Serife Ceren Uysal, a convenu que la première conférence se tiendra sous forme d’un événement virtuel le 14 juin 2021 et portera sur le droit à un procès équitable en Turquie.

Nous vous écrivons à ce stade pour vous informer de cette initiative et pour inviter votre organisation à soutenir la Journée internationale du procès équitable et à participer à la conférence. De plus amples détails sur le programme et les intervenants de la conférence suivront dans les prochains mois. Pour l’instant, nous vous demandons de retenir la date pour reconnaître ce qui, nous l’espérons, sera un événement annuel et une remise de prix importants dans le calendrier international de l’état de droit.

Uluslararası Adil Yargılanma Hakkı Günü ve Ebru Timtik Ödülü

Adil yargılanma hakkı uluslararası kamuoyu tarafından çok uzun bir süre önce temel bir insan hakkı olarak tanınmıştır. Adil yargılanma hakkının yokluğu durumunda her bir birey, ya masum bir şüpheli iken hatalı bir şekilde hüküm giymek, ya da kendilerinin maruz kaldığı bir haksızlık karşısında adalet güvencesinden yoksun kalmak suretiyle adli bir hatanın kurbanı olma riski ile karşı karşıya kalabilir.

Ebru Timtik, İstanbul 37. Ağır Ceza Mahkemesi tarafından Türk Ceza Kanunu madde 314 ve 220 bağlamında terör suçları isnat edilerek yürütülen bir yargılamanın öznesi olmuş, büyük kısmı Halkın Hukuk Bürosu çalışanı ve tamamı Çağdaş Hukukçular Derneği üyesi olan 18 avukattan biriydi. Timtik ve meslektaşları 20 Mart 2019 tarihinde en temel usul güvencelerinin ve uluslararası alanda tanınmış adil yargılanma hakkı prensiplerinin ihlal edildiği bir yargılamanın akabinde hüküm giydi. Timtik’e verilen hüküm temel olarak gizli tanık ifadelerine dayanmaktaydı ki bu ifadelerin büyük çoğunluğu iddialara esas olan olgular ve zaman çizelgesi ile de tutarsızlık göstermekteydi. Belçika ve Hollanda hükümet yetkililerinden temin edildiği iddia edilen belgeler, yargılama boyunca resmi olarak tasdik edilmemesine rağmen, avukatların erişimine açılmadı ve hükme esas alındı. Bir kültür merkezinde ele geçirildiği iddia edilen söz konusu dijital belgelerin orijinalleri de yargılamanın hiçbir aşamasında savunma avukatlarına sunulmadı. Bu bağlamda savunma avukatları varlığı hiçbir şekilde gerçek anlamda var oldukları ortaya konulmamış olan bu belgeleri görmek, incelemek ve karşı iddialarını ileri sürebilmek şansına sahip olamadı. Savunma avukatlarının duruşmalara katılımları sıklıkla engellendi ve bazı durumlarda duruşma salonundan dahi çıkartıldılar.

Yargılama sürecinde yaşanan bütün bu usulsüzlüklerin akabinde, Ebru Timtik, diğer bir meslektaşı Aytaç Ünsal ile birlikte Türkiye’de Avukatlar Günü olan 5 Nisan 2020 tarihinde süregelen açlık grevlerini ölüm orucu eylemi olarak sürdüreceklerini duyurdular. Ne yazık ki; Ebru Timtik, gerek haksız ithamlara rağmen maruz bırakıldığı ceza hükmünü, gerekse kendisi ve meslektaşları da dahil olmak üzere Türkiye’de binlerce insanın ceza adaleti sisteminde adil yargılanma hakkının temel prensiplerinin ihlal edilmesi nedeniyle mağdur edilmelerini protesto ederken 27 Ağustos 2020 günü yaşamını kaybetti.

Ebru Timtik’in yaşamını kaybetmemesi için çabalayan, bir grup uluslararası baro örgütü ve avukat örgütü, Timtik’in iki meslektaşı ile birlikte, onun hayatını ortaya koyduğu mücadeleye ve adil yargılanma hakkı ilkelerinin ihlal edilmesi yahut bu ilkelere saygı duyulmaması koşulları altında yaygın yargılamalarla yüz yüze kalınan dünya genelindeki ülkelere dikkat çekebilmek için ‘Uluslararası Adil Yargılanma Hakkı Günü’nü düzenlemek için yan yana geldiler. Uluslararası Adil Yargılanma Hakkı Günü her yıl 14 Haziran’da gerçekleşecek ve her yıl bir ülke üzerine odaklanılacak. Aynı şekilde bugün kapsamında Uluslararası Adil Yargılanma Hakkı Günü’nün odaklandığı ülkede adil yargılanma hakkının güvence altına alınması için olağanüstü çaba harcayan kişi yahut kurumlara her yıl Ebru Timtik Ödülü’nün verilmesi ve kurumsallaşması için de adımlar atıldı. Her yıl Uluslararası Adil Yargılanma Hakkı Günü kapsamında online yahut yargılanmalarda adil yargılanma hakkına gösterilmesi gereken saygının gösterilmemesi nedeniyle o yıl içinde seçilmiş bir ülkede fiziksel katılıma açık bir konferans düzenlenecek. Yine her yıl Uluslararası Adil Yargılanma Hakkı Günü kapsamında seçilmiş ülkedeki durum hakkında farkındalığı büyütmek amacıyla dünyanın dört bir yanında da etkinlikler düzenlenecek.

Avrupa Barolar ve Hukuk Cemiyetleri Konseyi (CCBE), Demokrasi ve İnsan Hakları İçin Avrupalı Avukatlar Derneği (ELDH) Avrupa Barolar Federasyonu (FBE), Avrupalı Demokrat Avukatlar (EDL-AED), Fransa Barolar Birliği (CNB), Uluslararası Demokratik Avukatlar Derneği (IADL), Uluslararası Avukatlar Derneği (UIA), Uluslararası Barolar Birliği İnsan Hakları Komitesi (IBAHRI), İtalya Barolar Birliği (CNF), İngiltere ve Galler Hukuk Topluluğu, Avukatlar için Avukatlar (L4L), Ayşe Bingöl Demir ve Şerife Ceren Uysal’dan oluşan yürütücü grup, Uluslararası Adil Yargılanma Hakkı Günü’nün ilki olacak olan 14 Haziran 2021 tarihinde uluslar arası çevrimiçi bir etkinlik organize etmeye ve bu gün kapsamında Türkiye’de yaşanan yaygın adil yargılanma hakkı ihlallerine odaklanmaya karar verdiler.

Bu aşamada sizlere, bu girişim hakkında bilgi vermek ve kurumunuzu Uluslararası Adil Yargılanma Hakkı Günü’ne destek olmaya ve 14 Haziran 2021’de düzenleyeceğimiz online konferansa katılmaya davet etmek için yazıyoruz. Konferans programı ve konuşmacılarla ilgili detayları önümüzdeki aylarda paylaşacağız. Şimdilik, hukukun üstünlüğü alanında uluslararası seviyede önemli bir yıllık etkinlik ve ödül olacağını umduğumuz bu günü takviminizde işaretlemenizi önemle rica ediyoruz.
