Regional human rights systems serve an important function in the promotion and protection of human rights. In Africa, the Americas, and Europe, the human rights systems of the African Union (AU), Organization of American States (OAS) and the European Union (EU) and their decision making, reporting and monitoring bodies and tribunals play a significant role among their member states. They define and protect human rights, including by deciding States’ responsibility for violations alleged in complaints submitted by groups or individuals. Each geographical system has its own set of treaties and other instruments, courts, tribunals, monitoring bodies and enforcement mechanisms. Member states may be found accountable for violations of human rights caused by the state laws or policies or by state agents. While each system has its strengths, weaknesses and distinguishing characteristics, the purpose of all three systems is to interpret the scope and application of the treaty law regarding individual and groups rights and state duties, identify rights violations, recommend redress the state is obliged to provide to victims, and the measures necessary to prevent recurrence. This course will critically examine the Inter-American, European and African human rights systems.
