Unilateral coercive measures against any country, and especially against the countries of the South, have a negative impact on the entire population.
The Bolivarian Republic of Venezuela is being besieged by such unilateral coercive measures implemented by the states of the North, specifically by the United States of America, Canada and the European Union. These unlawful measures seek to deprive the Venezuelan people of medicine, food and other basic necessities and thus to undermine human rights, especially those of vulnerable groups and sectors. All of these measures are contrary to international law and to the Charter of the United Nations.
Since 2014, an escalation of these unilateral coercive measures has been initiated, led by the United States, through the implementation of executive orders that seek to limit, hinder and persecute any nation or company that trades with Venezuela. Likewise, these measures have been aimed at blocking all goods and interests of the Venezuelan Government that are in the United States, so that they cannot be transferred, paid for, exported or withdrawn from that country.
These unilateral measures constitute, from the legal point of view and due to their concrete effects, an economic, financial and commercial blockade against Venezuela, which has a direct impact on the human rights of its citizens, while negatively affecting the socio-economic development of the country. They directly affect the right to life, physical integrity, health and food of the Venezuelan people, in violation of the Covenant on Economic, Social and Cultural Rights; the International Covenant on Civil and Political Rights and the UN Convention on the Rights of the Child; and the American Convention on Human Rights of the OAS.
These measures have been dictated in an arbitrary and unilateral manner and carry legal effects and international responsibility on the part of those who apply them, and constitute a crime against humanity since they hinder access to goods and services necessary for the social development of the Venezuelan people, in addition to violating international law and the principle of self-determination of peoples.
The International Association of Democratic Lawyers (IADL) demands respect for the right of the Venezuelan people to choose their form of government and the governmental leadership they wish without interference from other States. For this reason, we reject any action aimed at undermining their will and rights through economic pressures and attempts to destabilize the democracy that exists in Venezuela on the part of the imperialist powers of the world.
Faced with these facts, we wish to state that:
- We express our deepest rejection of the economic actions and measures carried out by the government of the United States that attempt to exert pressure against the Venezuelan people. These constitute a very serious violation of international law and human rights.
- We demand that the international community, and especially the United Nations, pronounce clearly against the economic blockade of Venezuela and establish the international responsibility of the United States for its violation of human rights.
- We urge the States of the world to respect the rights of the Venezuelan people to self-determination and non-interference in their internal affairs and, in particular, to cease threats against them and the application of any unilateral coercive measures.
- We request the government of the United States of America to immediately lift the unilateral coercive measures against the Venezuelan State, which have caused an immoral, unjust and illegal economic, financial and commercial blockade, which has caused suffering and serious effects on human rights, especially on the life, health and food of the most vulnerable populations.
Las medidas coercitivas unilaterales contra cualquier país y sobre todo contra los países del Sur producen repercusiones negativas contra toda su población. La República Bolivariana de Venezuela está siendo asediado por medidas aplicadas desde los estados de norte, específicamente por Estados Unidos de Norte América, Canadá y la Unión Europea, que buscan privar al pueblo de Venezuela de medicamentos, alimentos y otros insumos básicos, pretendiendo así menoscabar los derechos humanos, especialmente de grupos y sectores en situación de vulnerabilidad. Todas estas medidas van en contra del derecho internacional y de la Carta de Naciones Unidas, donde el único afectado es el pueblo concernido.
Desde el año 2014 se ha iniciado una escalada de medidas coercitivas, lideradas por EE.UU. mediante la aplicación de ordenes ejecutivas que buscan limitar, obstaculizar y perseguir, a toda aquella nación o empresa que comercie con ese país. Igualmente, esas medidas se han dirigido a bloquear todos los bienes e intereses del Gobierno de Venezuela que se encuentran en Estados Unidos, a fin de que no puedan ser transferidos, pagados, exportados o retirados de ese país.
Estas medidas unilaterales generan, desde el punto de vista jurídico y por sus efectos concretos, un bloqueo económico, financiero y comercial contra Venezuela, que impacta directamente en los DDHH de las y los ciudadanos, al tiempo que afecta negativamente el desarrollo socioeconómico del país. Afectan de manera directa el derecho a la vida, integridad física, salud y alimentación del pueblo venezolano, generando una violación del Pacto de Derechos Económicos, Sociales y Culturales; el Pacto Internacional de Derechos Civiles y Políticos y la Convención sobre Derechos del Niño de la ONU; y, la Convención Americana de Derechos Humanos de la OEA.
Estas medidas, se han dictado de manera arbitraria y unilateral y producen efectos jurídicos y responsabilidad internacional por parte de quien las aplica, y configuran un delito de lesa humanidad ya que dificultan el acceso a bienes y servicios necesarios para el desarrollo social del pueblo venezolano, además de violar el derecho internacional, y el principio de autodeterminación del pueblo.
Desde la AIJD exigimos respeto a su derecho a elegir la forma de gobierno y los gobernantes que deseen sin injerencia de otros Estados, por lo que rechazamos toda acción dirigida a menoscabar su voluntad y derechos a través de presiones económicas e intentos de desestabilizar la democracia que existe en Venezuela por parte de las potencias imperialistas del mundo.
Ante estos hechos, deseamos manifestar que:
- Expresamos nuestro más profundo rechazo a las acciones y medidas económicas ejecutadas por el gobierno de Estados Unidos que intentan ejercen presión contra el pueblo venezolano, por constituir una gravísima violación al derecho internacional y los derechos humanos.
- Exigimos a la comunidad internacional, y en especial a las Naciones Unidas se pronuncie contra el bloqueo económico a Venezuela y establezca la responsabilidad internacional de Estados Unidos por violación a los derechos humanos.
- Exhortamos a los Estados del mundo a respetar los derechos del pueblo venezolano a la libre determinación y a la no injerencia en sus asuntos internos y, muy especialmente, a cesar las amenazas en su contra y la aplicación de cualesquiera medidas coercitivas unilaterales.
- Solicitamos al gobierno de Estados Unidos de América el levantamiento inmediato de las medidas coercitivas unilaterales contra el Estado venezolano, que han ocasionado un bloqueo económico, financiero y comercial inmoral, injusto e ilegal, que ha causado sufrimiento y serias afectaciones en los derechos humanos, especialmente a la vida, salud y alimentación de las poblaciones más vulnerables.
